Job taking a toll on Chronic Pancreatitis

Well I started working for the federal government a couple months ago and they knew i had to have a transplant out in MN when i started here and now that I told them when the surgery is they say its an issue being off 6 weeks and terminated me last week, i am at a lost of words. The fired me 2 months before that actual surgery was supposed to take place and they didn’t care. what do i do now?

Wow. That is terrible news to hear. I know that the Family Medical Leave Act only protects you if you have been with a job for 12 months.

My advice is to do whatever you can to maintain your health coverage. In Nebraska, you are able to continue coverage you had under an employer for up to two years by paying the entire deductible yourself. I know that sounds like a lit but if you do not maintain continuous coverage at this point your pancreas issues will become a preexisting condition and would be exempt from future health coverage.

Second, you can contact an attorney that specializes in employment law. They will talk to you about your situation without charging you money and if they won’t then they aren’t a good lawyer and you should call someone else.

Third, you could contact a senator or congressmans office or a state elected official for help connecting to resources. I would think that your situation would make you eligible for unemployment benefits.

Lastly, call your doctors office to see if they have any of your drugs as samples to help out with the situation.

I am an eternal optimist. Life happens and you can’t stop it. I know you can handle it. You gave gotten through so much already.

Unfortunately, if you are still in a new hire position (typically less than 3 months) you can be dismissed for any number of reasons that would otherwise be illegal. In my job, it was called a “probationary” period. However, it does make a person that was working full time eligible for unemployment benefits. It is one of the main reasons that I have not pursued any new jobs in the last year - I have been in my current position for 5 years and that provides me with some protections that I wouldn’t have other places.

Yes Amanda you are correct. ( I jumped the gun on this one) However, even if it’s less than 3 months and they use health reasons, isn’t it still illegal? I don’t know -

Unfortunately, no it is not. It was part of the original proposal from Bill Clinton in 1993 but the end product, the Family Medical Leave Act only provides protection after 12 months of employment.

Many of the call centers in my town will dismiss you after 3 absences, regardless if you have doctor certification.
